Include your name and address or nothing will come of it I'm contacting you to express my opposition to the BATFE's letter regarding the designation of M855/SS109, 5.56mm ammunition as armor piercing. Per "18 U.S. Code Section 921," M855 does not fit either provided definition of armor piercing as the projectile's core is neither entirely made of any of the listed metals/alloys OR has a jacket weight exceeding 25% of the projectile's total weight. Therefore, M855/SS109 should continue to be exempt as it doesn't meet the criteria defined by law to be armor piercing. Hmm, you'd be better off actually addressing what they said. M855 was NOT mentioned. It was about "sporting purposes exception".

Basically they say they're going to allow full Armor Piercing bullets in .22 cal rimfire so that gangbangers can shoot our serving peace officers all day long, and of course the BATF can have more reason to exist, more money, and more officers, but they're going to ban ANY rifle surplus they feel like, with NO exceptions. Yes, 54R will be banned too. Basically, it's the exact OPPOSITE of the original law's intent.

M855 is NOT the point here.

Read below. #1 allows gangbangers full AP with hot .22 rimfire, #2 bans rifle surplus. It's a super-special twofer. And meanwhile everyone is focused on M855 like that's the issue. It is NOT.

Here's what they ACTUALLY said:

Category I: .22 Caliber Projectiles

A .22 caliber projectile that otherwise would be classified as armor piercing ammunition under 18 U.S.C. 921(a)(17)(B) will be considered to be “primarily intended to be used for sporting purposes” under section 921(a)(17)(C) if the projectile weighs 40 grains or less AND is loaded into a rimfire cartridge.

Category II: All Other Caliber Projectiles

Except as provided in Category I (.22 caliber rimfire), projectiles that otherwise would be classified as armor piercing ammunition will be presumed to be “primarily intended to be used for sporting purposes” under section 921(a)(17)(C) if the projectile is loaded into a cartridge for which the only handgun that is readily available in the ordinary channels of commercial trade is a single shot handgun. ATF nevertheless retains the discretion to deny any application for a “sporting purposes” exemption if substantial evidence exists that the ammunition is not primarily intended for such purposes.

PS, Not a big fan of M855 so it's not the end of the world, but lots of people like it and there's no legitimate reason it should be banned.

Funny - when our hijacked government banned 5.45x39, there were some who pointed out the fact they had over-stepped their authority and the law they claimed supported the ban didn't actually apply. Many wrote letters but STILL TODAY the milsurp 5.45x39 was banned for exactly the same reason. Our government has done NOTHING to correct their mistake. Opportunistic retailers raised prices across the board and the stuff is almost sold out everywhere. Since the BATF and the corrupt government figured they had gotten away with illegally banning 5.45x39, now they're taking the same action on the 5.56x45 round, however, there's a much larger population here so hopefully the government will be placed in check and this will get overturned across the board.

RIGHTS are understood by all thinking men through out all ages to be SELF EVIDENT and PREEXISTENT. Whether you side with the majority of the founding fathers as a Christian and see those rights as ordained supernaturally, or whether you side with Jefferson who saw rights as pertaining somehow to nature.

Even SCOTUS agrees with the above, stating very clearly that the second amendment does not create a right, it merely states one that ALREADY EXISTED.

I urge you to read more widely and not take offense when others suggest it.

Unfortunately in the U.S. today grumpy is correct. The majority of the electorate have traded their rights as a free man for the protection of the state. They have chosen to live as serfs assuming the master will protect them. It will only get worse as the man tells us what health care to buy, what we are allowed to eat, how we are allowed to dtefend ouseves. Do I need to continue with examples?
