Castle nut is not the problem. I would be careful with all the attention brought to AR pistols lately. The lower should specifically state "pistol" on it somewhere. This may get more scrutiny in the future and avoiding 10 years in the stoney lonesome is a good thing.

An AR pistol is classified as a handgun. The lower does NOT have to state "pistol" anywhere on it, just like any Glock, 1911, or any other handgun. Same laws apply.

I think the pistol classification is more of a "paperwork" issue. I ordered a pistol lower from Palmetto State Armory not long ago and nowhere on the lower that I could find does it have pistol on it. It looks just like a regular lower with a pistol buffer tube on it. I assume the FFL guy that did the transfer for me recorded it as a pistol, because that was how it was configured. I was a little disappointed that the pistol designation was not on the lower. But from what I have read, it does not matter as long as it is recorded as a pistol. It is also my understanding that stripped virgin receivers are recorded as "other" and they can be built as a pistol or rifle and I could have done the same thing had I ordered a stripped lower. Fortunately, the price was very good for the pistol lower, so I would have probably ordered it anyway.
